Judge Steve Burgess declared a mistrial Wednesday in the murder case involving Deon Kingston Jr.Kingston, a 20-year-old from Frisco, was tried in 158th District Court in the death of Denton resident Samira Siwakoti, who was fatally shot June 10, 2015, while working at the Rapido Convenience Store in The Colony. Siwakoti co-owned the store with her husband, Nadaraj Siwakoti.
Kingston was accused of killing Samira Siwakoti, 31, during an alleged robbery at the convenience store. A grand jury indicted Kingston on a murder charge Sept. 11, and bail was set at $1 million.
The indictment was re-filed in December with changes to the original document’s language, Jamie Beck, first assistant district attorney for Denton County, previously told the Denton Record-Chronicle.
Beck said via email Wednesday that the district attorney’s office had “no additional comments … at this time.”
According to a declaration signed by Burgess, the court declared a mistrial “based upon an oral motion by the defense.” The judge also ordered the case to be “reset for jury trial upon a date to be determined.”
Kingston is ordered to remain in the Denton County Sheriff’s Office custody on the bond set when he was indicted, according to the declaration.
Mick Meyer, Kingston’s attorney, said Burgess ruled a mistrial after it was identified that some of “the forensic testing was not yet completed on some of the state’s evidence.”
